Having the authority to cremate the body of a deceased person is provided for by law.  There are specific rules and regulations to follow to ensure the rights of the deceased and their next of kin.

There is a form provided by cremation professionals that is called the Authorizing Agent(s) Priority Signature List.  Here is an edited version provided as information as to who has authority to cremate.  A complete version of this form is available from LocalCremation.com.

  • First Priority.  All persons designated in a written instrument signed by the decedent.  This written instrument, known as the appointment of agent to control disposition of remains can be found in the Texas Health and Safety Code Title 8.  A copy of the written instrument must be attached to the authorization for cremation and disposition.
  • Second Priority.  The decedent’s surviving spouse.
  • Third Priority.  All of the decedent’s surviving children.
  • Fourth Priority. All of the decedent’s surviving parent(s).
  • Fifth Priority.  All fo the decedent’s surviving adult siblings.
  • Sixth Priority.  All adult persons in the next degree of kinship in the order named by law to inherit the estate of the decedent.
