Having the authority to cremate the body of a deceased person is provided for by law.  There are specific rules and regulations to follow to ensure the rights of the deceased and their next of kin.

There is a form provided by cremation professionals that is called the Authorizing Agent(s) Priority Signature List.  Here is an edited version provided as information as to who has authority to cremate.  A complete version of this form is available from LocalCremation.com.

  • First Priority.  All persons designated in a written instrument signed by the decedent.  This written instrument, known as the appointment of agent to control disposition of remains can be found in the Texas Health and Safety Code Title 8.  A copy of the written instrument must be attached to the authorization for cremation and disposition.
  • Second Priority.  The decedent’s surviving spouse.
  • Third Priority.  All of the decedent’s surviving children.
  • Fourth Priority. All of the decedent’s surviving parent(s).
  • Fifth Priority.  All fo the decedent’s surviving adult siblings.
  • Sixth Priority.  All adult persons in the next degree of kinship in the order named by law to inherit the estate of the decedent.

We are proud to announce the opening of our newly completed cremation center that houses our second state-of-the-art crematory retort.  This new machine adds additional identification procedures requiring our certified crematory operators to scan bar codes before the machine can be operated.  Bar codes are assigned to a family’s loved one’s cremation permits and paperwork, then a second scan verifies the bar code assigned when the body is brought to our facility.

Our cremation center also allows for a family to comfortably witness the start of the cremation process in our witnessing room.  If for personal or religious reasons a family wishes to start the cremation process they may do so by operating these controls on the interior of the witnessing room.

Soon after cremation, your loved one’s ashes are returned to you.  Most providers offer many styles of urns, scattering urns and shipping containers.  They will seal the cremated remains into the container of your choice while you wait.  They can also mail the container to you or deliver it to you by appointment.  Cremated remains are generallya vailable 12 hours after teh cremation takes place, but can be expedited for same day pick up, too.

One of the key questions to ask your funeral director or cremation services provider is:

“Is embalming required?”

Embalming is not required by law.  Most crematories require embalming only if there is going to be a public viewing.  If there are family members, friends or loved ones who did not get a chance to say goodbye, most service providers can schedule a time for a small, private viewing prior to cremation without embalming.
